Children Being Tried as Adults
Thousands of kid criminals in the United States have been tried as adults and sent to prison (Equal Justice Initiative). The debate whether these kids should be tried as adults is a huge controversy. The decision to try them or to not try them as an adult can change their whole life. “Fourteen states have no minimum age for trying children as adults” (Equal Justice Initiative). Some people feel that children are too immature to fully understand the severity of their actions. People who are for kids to be tried as adults feel that if they are old enough to commit the crime, then they are old enough to understand what they are doing. There are people who feel that children should only be tried as adults depending on the crime.
According to the article of “Should Juveniles Be Tried as Adults?” at Buzzle.com, “It is a proven fact that when a child is at the age around nine or ten that they do not have the mental accessibility to think as an adult” (Borkar). Citizens see this statistic as a reason as to why children should not be tried as adults. “Children are five times more likely to be sexually assaulted in adult prisons than in juvenile facilities” (Equal Justice Initiative). These juveniles are subject to much harsher punishments which includes life sentencing (Michon). These people do not feel that these children should be in a prison for the rest of their life for something they did when they were 13. As you can tell, this topic is very controversial with very different, strong points of view. All of the people with these opinions are extremely compelling and will stick to what they believe and feel. This is a very important topic that involves everyone in the United States and the rest of the world. There are many numerous different angles and techniques to look at this issue that it has been very hard to solve. It can determine if this child will be in jail with adults 50 years old or not. This problem can determine the rest of child’s life and their future.
Within the last five years, violent offenses by children have increased 68 percent, crimes such as: murder, rape, assault, and robbery. Honestly, with these figures, it is not surprising at all that the Juveniles Courts focus less on the children in danger, and focus more on dangerous children. Heinous crimes are considered brutal and common among adults who commit these crimes, but among children with a young age, it is something that is now being counted for an adult trial and punishable with life sentencing. Although some people agree with this decision being made by judges, It is my foremost belief that juveniles don’t deserve to be given life sentencing without being given a chance at rehabilitation. If this goes on there’s no point in even having a juvenile system if children are not being rehabilitated and just being sent off to prison for the rest of their lives and having no chance getting an education or future. Gail Garinger’s article “ juveniles Don’t deserve Life sentence”, written March 14, 2012 and published by New york Times, mentions that “ Nationwide, 79 adolescents have been sentenced to die in prison-a sentence not imposed on children anywhere else in the world. These children were told that they could never change and that no one cared what became of them. They were denied access to education and rehabilitation programs and left without help or hope”. I myself know what it’s like to be in a situation like that, and i also know that people are capable of changing even children when they are young and still growing.
According to criminal.findlaw.com the definition of the juvenile justice system is the area of criminal law applicable to people not old enough to be held responsible for criminal acts. Juveniles are people 17 and under. Juveniles should be convicted as adults for violent crimes like assault or murder etcetera because if they can commit an adult crime they should get an adult punishment. Also if juveniles don’t get punished for their crimes then they’ll keep doing it because they got off unpunished the first time.
Juveniles are more than just kids. They are capable of doing anything an adult is capable of doing. One has probably heard the saying, “If you want to be treated like an adult, then act like an adult.” If they’re going to do crimes that “only” adults are capable of doing, then they should treated like an adult and be tried and sentenced like one. Imagine being close to a murder victim, wouldn’t you want them to feel hell? “How would you feel if you never got to see your child alive again while their killer served only a short sentence before being released from jail?” (hchs1259). This quote hits hard. One can only imagine being in the position of a parent whose child was murdered.
Each year in the United States, children as young as 13 years old are sentenced to spend the rest of their lives in prison without any chance of getting released. There has been a worldwide agreement declaring that children cannot be held to the same standards of responsibility as adults and it is recognized that children are entitled to special protection and treatment. There are three types of juvenile waivers that have been allowing juveniles to be treated as adults in adult court. The Miller v. Alabama case is a step toward more just treatment of juvenile offenders following several decades’ worth of harsh treatment of youthful offenders.
There has always been controversies as to whether juvenile criminals should be tried as adults or not. Over the years more and more teenagers have been involved in committing crimes. In some cases the juries have been too rough on the teens. Trying teens as adults can have a both positive and negative views. For example, teens that are detained can provide information about other crimes, can have an impact in social conditions, and serve as experience; however, it can be negative because teens are still not mature enough for that experience, they are exposed to adult criminals; and they will lose out on getting an education.
Their brains develop in different stages and they learn skills that they need to learn at certain time. In the article “Juveniles Don’t Deserve Life Sentences”, by Garinger, she argues that juveniles should not be treated as adults if they commit horrible crimes. Garinger states that juveniles should not be sentenced to life in prison without parole. She states that the court is considering life in prison without parole for juveniles who commit capital crimes. Garinger says that juveniles are immature, and still developing, so they can not be held to the same standards as adults. The writer add that as a juvenile court judge, she has seen how that juveniles can change and may become rehabilitated. For example, the court has already struck down death penalty and the life in prison without parole for juveniles or for young offenders convicted of non-homicide. According to the article, “Juveniles Don’t Deserve Life In Prison,” Paul Garinger states that “Brain imaging studies reveal that the regions of the adolescent brain are responsible for controlling thoughts, actions, and emotions are not fully developed. “Some 10,000 children are housed in adult jails and prisons on any given day in America.” One of the most controversial questions is should Juvenile criminals be tried as adults or not. The amount of children in adult prisons are rising. It’s not always the children's fault for their poor choices; half of the time they are influenced by their environment or parents. Children who are way too young to see and R rated movie without a parent or guardian are being sent to adult prisons. The laws that will send children to an adult prison is barbaric, corrupt, and unfair. Adult prisons are also very dangerous for minors, and would lead to more crimes.
The first article; “Adult Crime; Adult Time.” by Linda J. Collier is about how the juvenile delinquents of the world should be thrown right in with the hardened criminals. She talks about the Jonesboro, Arkansas incident in which 11-year-old Andrew Golden and 13-year-old Mitchell Johnson, slaughtered their classmates as they ran from the school building. They pulled the fire alarm and began their assault with a barrage of bullets. In this particular situation, “they are still regarded by the law as children first and criminals second.”(Pg. 620). This has not been the first time that young children have committed such crimes, but the average of violence committed by children has risen by 60% since 1984. She claims that because of these statistics, we need to update the juvenile justice system. “In recent years many states have enacted changes in their juvenile crime laws and some have lowered the age at which a juvenile can be tried as an adult for certain violent crimes.” (Pg. 620) According to this author, she feels that it is a start in the right direction. She claims that she has represented children as a court appointed guardian and is humbled trying to help children out of their difficulties which often due to circumstances beyond their control. Still, for violent crimes, she feels that “children who knowingly engage in adult conduct and crimes should automatically be subject to adult rules and adult prison time.”
“‘Anyone who has a 22-year-old living in his childhood bedroom,” Schiraldi says, “knows they aren’t the same as older adults.’” (Requarth). Adolescents are increasingly tried in adult courts due to their crimes committed, these courts are more severe and harsh in their sentencing, which is not suitable for juveniles. The juvenile justice system was designed to serve the best interests of the child, by helping them with the use of unparalleled and extensive knowledge about adolescents and how their needs differed from that of adults. The adult courts are incapable of satisfying the necessities of juveniles. Juveniles deserve to be tried the same as adults when they commit certain crimes. The justice systems of America are becoming completely unjust and easy to break through. Juvenile courts haven’t always been known to the everyday person.
Children are being sentenced to life in prison after The Supreme court has ruled that children should be treated differently than adults. The American Society has noticed that crime rates have risen throughout the years by minors. These crime rates have risen at the same time frame as the rates of child abusing and single parenting. Many people consider this to be an explanation of why the juvenile crime rates rose. The Juvenile Justice System is a network that includes any agency that analyze juveniles. These agencies include police, detention, court, probation and the Department of Juvenile Corrects. Yet, these agencies still allow young offenders to be moved to mandatory Adult Court if they commit a murder. Juveniles should not be sentenced to adult prison because The Eighth Amendment claims to protect juveniles from cruel and unusual punishment, and teenage brains are not yet developed enough to be sensed into Adulthood. However, more juveniles are being sentenced to adult prison because laws are overwriting The Constitution.

Should juveniles be sentenced to prison for life? Should juveniles be trialed as adults after committing a heinous crime and sentenced to life? As a teenager, this question is far too complicated to answer because I am a teenager yet in my opinion, I believe that the juvenile should not be sentenced to life. I believe that there is another way to punish them for their crimes. The last execution was in 2006 in California.
Today?s court system is left with many difficult decisions. One of the most controversial being whether to try juveniles as adults or not. With the number of children in adult prisons and jails rising rapidly, questions are being asked as to why children have been committing such heinous crimes and how will they be stopped. The fact of the matter is that it is not always the children's fault for their poor choices and actions; they are merely a victim of their environment or their parents. Another question asked is how young is too young. Children who are too young to see an R rated film unaccompanied are being sent to adult prisons. The only boundaries that seem to matter when it comes to being an adult are laws that restrain kids from things such as alcohol, pornography, and other materials seen as unethical. Children that are sent to adult prison are going to be subjected to even more unprincipled ideas and scenes. When children can be sent to jail for something as minor as a smash and grab burglary, the judicial system has errors. The laws that send juveniles to adult prisons are inhumane, immoral, and unjust. Kids are often incompetent, which leads to unfair trials. Adult prisons are also very dangerous for minors, and in many cases this leads to more juvenile crimes.
