There is a lot of controversy over same sex marriage. Some are for such marriage and others are against it. Personally, I am against same sex marriage. I feel as if same sex marriage should not be allowed in the US. In order to ban same sex marriage an amendment must be passed. To have an amendment passed both Houses of Congress must propose the amendment with a two-thirds vote. This is how all current amendments have been offered. Also two-thirds of the State legislatures must call on Congress to hold a Constitutional Convention.
In order for an amendment to be ratified three-fourths of the State legislatures must approve of the amendment proposed by Congress, and three-fourths of the states must approve the amendment via ratifying conventions. This method has only been used once, to repeal Prohibition (21st Amendment). Yes I do think an amendment is needed to ban same sex marriage. If an amendment is used to ban such marriage, then that would make it unconstitutional. I do not favor same sex marriage. I feel as if same sex marriage is a sin and that people should avoid living that sinful lifestyle and live right, by God. The amendment mandates that "marriage between one man and one woman is the only domestic legal union that shall be valid or recognized." Opponents of the measure ran ads stressing the impact the language would have on straight North Carolina residents, arguing that the measure would eliminate protections against domestic violence. There are 30 states that are for banning same sex marriage. The “Don’t Ask, Don’t Tell” policy that prevented gays, lesbians, and bisexuals from openly serving in the military was effective from 1993 to 2011...

    For some background, this case escalated to the Supreme Court since several groups of same-sex couples from different states, sued state agencies when their marriage was refused to be recognized. As it escalated through appeals, the plaintiffs argued that the states were violating the Equal Protection clause and the Due Process Clause of the Fourteenth Amendment. Equal Protection, according to the Constitution refers to the fact that, “any State [shall not] deprive any person of life, liberty, or property, without due process of law…” (23). The opposition of this case was that, 1) The Constitution does not address same-sex marriage as a policy, and 2) The sovereignty of states regarding the decision. Ultimately, and according to the Oyez project, the Court held that “[the Amendment] guarantees the right to marry as one of the fundamental liberties it protects, and that analysis applies to same-sex couples,” and therefore, same-sex marriage is a fundamental liberty.
