Summary of the Case On August 1987, Donald Butler opened a store in Winnipeg, Manitoba, called the “Avenue Boutique”. In this store, Butler sold and rented pornographic publications that were considered “hard core” and sexual paraphernalia. A couple weeks later, the City of Winnipeg Police searched and seized Butler’s sexually explicit materials lawfully. From this, Butler was charged with 173 counts under s. 163 of the Criminal Code. These charges included s. 163(1)(a) which criminalizes the distribution and the possession for distribution of obscene materials, as wells s. 163(2)(a) for selling and exposing obscene material to the public.
In class, we watched a film called Ethnic Notions. In this film, it brought to light how devastating and powerful images can be. Due to exaggerated images and caricatures created pre-civil war era of black men and women, stereotypes were created and have negatively affected the black race in society. Caricatures, such as the Sambo, Zip Coon, Mammy, and Brute, have unfortunately been engrained in the minds of generations. So much so their stereotypes still persist today.
In his essay “Black Men and Public Space,” Brent Staples discusses his personal experiences of being an African American male, while coming to the realization of the harsh realities of the stereotypes it carries. Through his anger and frustration, he learned to alter himself in public spaces by making others around him feel less threatened. Not always would it work, such as the occasional double glances he’d get from the person in front of him or a click when walking past someone in their car. Even so, he says that when he’s out walking the streets of Brooklyn at night, he finds that women “set their faces on neutral”, place their purses “across their chest bandolier style”, and “forge ahead as though bracing themselves from being talked” (Staples 543). With this use of imagery, Staples is able to place an image in the reader’s head of a young women walking the streets- alone, tense, and skittish- all because of man who, unbeknownst, means no harm to her. This denotes the theme of racial profiling in society because it shows the woman’s fear of an African American walking the streets, whom of which has not made one advance or threatening move towards the woman. The woman’s ability to assume the worst in the blink of an eye shows how society has been drilled with the influence of stereotypes and racial profiling. This leads to the fact that an innocent man is being ridiculed for the color of his skin while he had done nothing to cause such actions. Moreover, the description of the woman’s reaction to Staples makes the audience pity him because of his innocence in the cruel and unfair situation and unwillingness to be anybody other than an innocent bystander. Many people claim that racism no longer exists; however, the minorities’ struggle with injustice is ubiquitous. Since there is a mass incarceration of African Americans, it is believed that African Americans are the cause of the severe increase of crimes. This belief has been sent out implicitly by the ruling class through the media. The media send out coded messages that are framed in abstract neutral language that play on white resentment that targets minorities. Disproportionate arrest is the result of racial disparities in the criminal justice system rather than disproportion in offenders. The disparities in the sentencing procedure are ascribed to racial discrimination. Because police officers are also biased, people of color are more likely to be investigated than whites. Police officers practice racial profiling to arrest African Americans under situations when they would not arrest white suspects, and they are more likely to stop African Americans and see them as suspicious (Alexander 150-176). In the “Anything Can Happen With Police Around”: Urban Youth Evaluate Strategies of Surveillance in Public Places,” Michelle Fine and her comrades were inspired to conduct a survey over one of the major social issues - how authority figures use a person’s racial identity as a key factor in determining how to enforce laws and how the surveillance is problematic in public space. This often happens because their is nothing proving a clear path of innocence or guilt. In the book Monster and the documentary Murder on a Sunday Morning, this can be demonstrated throughout. Based on the information given, the verdict of Steve Harmon seems to be incorrect while the verdict of Brenton Butler seems to be correct.

In the fire hydrant scene, the black people got the rich man’s antique car wet. When driving by, the police stopped to cease the water flow. When the rich man complained about his car, the police told him that he better g333et back to his car before the black people stripped it clean. The police referred to all blacks as criminals, which implied that whites were better than blacks, supporting the idea of white superiority over black people. Hollywood’s diversity problem is well-known; however, the extent might be surprising to most Americans. According to a 2014 report by the Center for the Study of Women in Television, Film & New Media, found that females comprised only 30% of all speaking characters among the top grossing films of 2013. (Lauzen, 2014) However, minority women faired far worse than their Caucasian counterparts. As a matter of fact, if one looks at the numbers even female characters from other world’s were as better represented in film than some minority women; the numbers are as follow for women: Caucasian (73%), African American (14%), Latina (5%), Asian and other world tied (3%). (Lauzen, 2014) If the lack of representation were not enough consider a 2009 study which found that when minority groups are portrayed on television the portrayal tends to be negative. (Alexandrin, 2009) A study by Busselle and Crandall (2009) found that the manner in which African-Americans are portrayed, often as unemployed criminals, tends to have an influence on the way the public perceives African-American’s lack of economic success. Furthermore, the news media does an equally poor job in the ways that African-American’s are presented; according to the same study while 27% of Americans were considered “poor” in 1996 the images of America’s “poor” being presented by news media was heavily Black (63%). (Busselle & Crandall, 2002) Today, this can be seen in the way that African-American victims of police brutality are depicted in the media. Police brutality and racism are an ongoing problem in our country. It goes back hundreds of years with no sign of it stopping. Police officers have been abusing their power since they have been around. Abuse against African American males by white police officers is getting out of hand. Most officers face no punishment at, and all there is a special code that they follow. Officers follow The “Blue Code of Silence”, which is a code that means they look out for one another. Even with video recording devices, the news, and social media, these events still go on. African Americans take most of the abuse and it looks like there is no end to this. This is a reflection on our society, and it makes us look ignorant to what is going on around us.
