Two of the most well known companies in their respective industries, Mattel and MCA Records, went to court over copyright and trademark. Mattel is an American toy manufacturing company best known for producing Barbie dolls, Hot Wheels and American Girl dolls. MCA Records was an American based record company best known for representing Lynyrd Sknyrd, Neil Diamond and Aqua.
Aqua is a well-known bubblegum euro dance band from Denmark. The group is made up of Soren Rasted, Lene Nystrom, René Dif, and Claus Norreen. The music companies MCA Records, Inc., Universal Music International Ltd., Universal Music A/S, Universal Music & Video Distribution, Inc., and MCA Music Scandinavia AB produced, marketed and sold Barbie Girl. Mattel had made claims that under the Federal Trademark Dilution Act (“FTDA”), the song has affected Barbie’s image. They state that “it diminishes the imagine to identify and distinguish Mattel products, and tarnishes it because the song is inappropriate for young girls.” The company has declared that Aqua portrays young women in the song as sexual objects, which is against the brand’s image and philosophy. In the music video, the character of Barbie portrayed by Lene Nystrom, sings the lyrics:
"I'm a blond bimbo girl / In a fantasy world / Dress me up, make it tight / I'm your dolly / Make me walk, make me talk / Do whatever you please / I can act like a star/ I can beg on my knees.” Company spokesman Sean Fitzgerald expressed in an interview with the Los Angeles Times in 1997, "We have expressed our extreme dissatisfaction with the song and with what we believe is a strong case for trademark violation.
