On 04-26-2018 at 1856 hours I was dispatched to 939 South Westwood Boulevard (Home Depot) in reference to shoplifting. Upon my arrival I was advised there was a white male in the store possibly shoplifting and he was in the store earlier today stealing. Upon the male exiting the store he was stopped and identified as Franklin Burkhart. Burkhart did not have any store property on him at the time of the stop. I was informed of the following by Joey Hessling, Home Depot loss prevention: - At approximately 1615 hours he located a package to a Ryobi 18v impact wrench. - Upon watching the video surveillance he found footage of a male subject selecting Ryobi Impact. - The male subject exits the isle and heads toward aisle 8 where he located the package to the impact. - He then left the store without paying for the merchandise. - At 1850 hours he seen the same male subject reenter the store so he called the police. - Upon watching the video surveillance further after the subject was arrested he observed the male …show more content…

I informed Burkhart of the reason for the stop and asked him if he had any Home Depot property on him and he advised no. I asked Burkhart if he minded emptying his pockets and he stated no and removed a pair of Husky Side cutter from his jacket pocket. Burkhart advised he got the side cutters from his dad earlier today. I noticed signs on the side cutter blades of prior use but it was very little and they looked new still. I did not seize the side cutters because at this time loss prevention was unware they were stole earlier in the day. Burkhart denied stealing earlier and stated he was not Home Depot earlier either. I was showed an image from the video surveillance and it showed Burkhart in the store wearing the same clothing and hat he had on at the time I stopped him. Burkhart did have deferent shoes on then in the video surveillance. Burkhart denied stealing anything from Home
