Discrimination, in one form or another, goes on everyday in the world around us. Discrimination affects all of us whether we are aware of it or not. Discrimination is defined as “unjustified differential treatment, especially on the basis of characteristics such as race, ethnicity, gender, sexual orientation, or religion” (MacKinnon). According to Eugene Lee of California Labor and Employment Law “racial discrimination and racial harassment” are the most popular complaint when it come to discrimination in the United States.

The father of the child obviously was very racist and made sure to make his point that no blacks were to work with his newborn. He also flashed a swastika tattoo on his arm to the shift supervisor to be sure Battle would not take care of his child. A note was then left on the babies’ chart that said “No African American nurse to take care of baby” (JoNel). Battle was very offended and filed a lawsuit, along with three other African American nurses, against the hospital for creating a hostile work environment. The Director of nurses, Mary Osika, was the one who made the decision to comply with the father. Osika stated her decision was intended for protecting Battle as well as any other African American staff from this father who appeared to be an aggressive racist. Battle won the lawsuit and between her and the other nurses over $200,000 was given by the Hospital (Ridley). They also state they want patients to speak up if there is a problem with their care or treatment so they can fix it. Therefore, Battle must comply to the patients request because of the contract she is under with the Hospital. The patient also has the right to request different care if he has a problem with the care he is receiving. Hurley Medical Center is also under their contract to honor a patients request for different care and therefore was abiding by their contract to ensure the patient was
