The individuals within our society have allowed we the people to assess and measure the level of focus and implementation of our justice system to remedy the modern day crime which conflict with the very existence of our social order. Enlightening us to the devices that will further, establish the order of our society, resides in our ability to observe the Individual’s rights for public order.
The governance of our present day public and social order co-exist within the present day individual. Attempts to recognize the essentiality of equality in hopes of achieving an imaginable notion of structure and order, has led evidence based practitioners such as Herbert Packer to approach crime and the criminal justice system through due process and crime control. A system where packer believed in which ones rights are not to be infringed defrauded or abused was to be considered to be the ideal for procedural fairness. “I would rather be exposed to the inconveniences attending too much liberty than to those attending too small a degree of it.” Thomas Jefferson pg 9 cjt To convict an individual because proper consideration was not taken will stir up social unrest rather then it’s initial intent, when he or she who has committed the crime is not punished for their doings can cause for a repetition and even collaboration with other’s for a similar or greater crime.
Is public order important? Most black Americans are under the control of the criminal justice today whether in parole or probation or whether in jail or prison. Accomplishments of the civil rights association have been challenged by mass incarceration of the African Americans in fighting drugs in the country. Although the Jim Crow laws are not so common, many African Americans are still arrested for very minor crimes. They remain disfranchised and marginalized and trapped by criminal justice that has named them felons and refuted them their rights to be free of lawful employment and discrimination and also education and other public benefits that other citizens enjoy. There is exists discernment in voting rights, employment, education and housing when it comes to privileges. In the, ‘the new Jim crow’ mass incarceration has been described to serve the same function as the post civil war Jim crow laws and pre civil war slavery. (Michelle 16) This essay would defend Michelle Alexander’s argument that mass incarcerations represent the ‘new Jim crow.’
Today, more African American adults are under correctional control than were enslaved in 1850, a decade before the Civil War began (Alexander 180). Throughout history, there have been multiple racial caste systems in the United States. In her book The New Jim Crow: Mass Incarceration in the Age of Colorblindness, Michelle Alexander defines a “racial caste” as “a racial group locked into an inferior position by law and custom” (12). Alexander argues that both Jim Crow and slavery functioned as racial caste systems, and that our current system of mass incarceration functions as a similar caste system, which she labels “The New Jim Crow”. There is now a silent Jim Crow in our nation. Mass incarceration today serves the same function as did slavery before the Civil War and Jim Crow laws after the Civil War - to uphold a racial caste system.
In the wake of President Obama’s election, the United States seems to be progressing towards a post-racial society. However, the rates of mass incarceration of black males in America deem this to be otherwise. Understanding mass incarceration as a modern racial caste system will reveal the role of the criminal justice system in creating and perpetuating racial hierarchy America. The history of social control in the United States dates back to the first racial caste systems: slavery and the Jim Crow Laws. Although these caste systems were outlawed by the 13th amendment and Civil Rights Act respectively, they are given new life and tailored to the needs of the time.In other words, racial caste in America has not ended but has merely been redesigned in the shape of mass incarceration. Once again, the fact that more than half of the young black men in many large American cities are under the control of the criminal justice system show evidence of a new racial caste system at work. In the United States, the rate of incarceration has increased shockingly over the past few years. In 2008, it was said that one in 100 U.S. adults were behind bars, meaning more than 2.3 million people. Even more surprising than this high rate is the fact that African Americans have been disproportionately incarcerated, especially low-income and lowly educated blacks. This is racialized mass incarceration. There are a few reasons why racialized mass incarceration occurs and how it negatively affects poor black communities.

In 1968, Herbert Packer was a Stanford University law professor who constructed two models of criminal process, due process and crime control. The due process model was Packer’s view that criminal defendants should be presumed innocent, courts must protect suspects’ rights, and there must be come limits placed on police powers. The crime control model is a model that emphasizes law and order and argues that every effort must be made to suppress crime, and to try, convict, and incarcerate offenders. As a country of many individualistic citizens, the United States has always tried its best to protect, but not coddle, its people in this area. Public order in today’s world is of high necessity, without it the world would basically be chaotic and we would not be able to live our normal lives or appreciate any of the freedom that we have today. In my view, public order is comparable to an everyday job; if you do the right things and follow the rules at a job, then you will soon or later be rewarded or receive good compliments, but if you do not follow the rules and continue to do things wrong then you can end up losing your job completely. Public order denotes keeping the public safe and keeping things orderly. Public order laws are laws that are created to stop riots, violent behavior and other activities or behaviors that can lead to serious public harm. Individual rights involve protecting an individual's right to do something regardless of its potential impact on public harm. An example of an individual rights law would be the law of free speech. In the United States, citizens are allowed to speak freely because of the first amendment and it does not matter whether or not this free speech adversely affects the government or the people.
