Abstract

Corruption is one of the major issues nowadays and is a clear example and consequence of the actual society and culture. A manifestation of this global phenomenon is the construction industry where corruption is really widespread and interconnected with other industries.

In our industry the majority of professionals consider corruption activities such as bribery to obtain planning permission or contracts; billing for unperformed work; production of fraudulent invoices; concealment of bribes; false or exaggerated claims; collusion and cartel activity; inclusion of extra cost to contract claim; cover pricing; employment of illegal workers; cover pricing; and leaking of information to a preferential bidder. The best example may be the connection between corruption in politics and construction. Are two areas that often have to work together and in which much money moves. All this has facilitated that corrupt people from both sectors work together to get the most benefit possible so that in the end all citizens have to pay their excesses.

In Spain there are many cases where politicians have charged illegal commissions in exchange for granting contracts, two large examples are “Gurtel case” and “three-percent scandal”. On both cases, politicians demanded a percentage in exchange for giving jobs or concessions. Another form of corruption present in Spain where this linkage is shown is the urban development with examples as “Operation Malaya”, where the perpetrators have been convicted of a multitude of illegal activities (bribery, embezzlement of public funds, breach of trust, influence peddling, etc.).
