Politically speaking, neoconservative racial projects deny the significance of race, which produces colorblind racial politics and policies that do not account for the ways in which race and racism still structure society. For example, legal scholar and civil rights attorney Michelle Alexander demonstrates in her book, The New Jim Crow, how the seemingly race-neutral “war on drugs” has been waged in a racist way due to racial biases in policing, legal proceedings, and sentencing, all of which result in the vast overrepresentation of black and Latino men in U.S. prisons. This colorblind racial project represents race as inconsequential in society, and suggests that those who find themselves in prison are simply criminals who deserve to be there.
Most black Americans are under the control of the criminal justice today whether in parole or probation or whether in jail or prison. Accomplishments of the civil rights association have been challenged by mass incarceration of the African Americans in fighting drugs in the country. Although the Jim Crow laws are not so common, many African Americans are still arrested for very minor crimes. They remain disfranchised and marginalized and trapped by criminal justice that has named them felons and refuted them their rights to be free of lawful employment and discrimination and also education and other public benefits that other citizens enjoy. In Michelle Alexander 's work, Drug War Nightmare: How We Created a Massive Racial Caste System in America, she talks about the social problem of inequality and discrimination in America. From being an African American to being a law professor and experience as a clerk for a Supreme Court justice, so it can give a reader a sense of comfort knowing that she knows what she is talking about. Alexander uses several methods of using logical and emotional appeals to the readers so they can get a glimpse of this national issue. She points out that there is a "New Jim Crow system" in the country that discriminates minorities in the legal system today and how it is a real problem that has a huge impact on American citizen 's lives.

More people today are being incarcerated than ever before and is the unfortunate result of prejudice and the prison industrial complex. Racism has existed for centuries and has never been eradicated, but it has taken different forms of expression. Many people today suffer from mental illnesses, homelessness, and other social problems that may not let them experience a fulfilling life. This can be due to their fault, but it is also due to the government system not taking proper action against these issues. Instead, the government chooses to incarcerate many of these people with social problems for felonies. In fact, Angela Davis states in her article that over 70 percent of those who are imprisoned are people of color. Many Americans pretend that the days of racism are far behind; however it is clear that institutional racism still exists in this country. One way of viewing this institutional racism is looking at our nation’s prison system and how the incarceration rates are skewed towards African American men. The reasons for the incarceration rate disparity are argued and different between races, but history points out and starts to show the reason of why the disparity began. Families and children of the incarcerated are adversely affected due to the discrimination as well as the discrimination against African American students and their likelihood of going to prison compared to the white student. African American women are also affected by the discrimination in the incarceration rate. Many white Americans don’t see how racism affects incarceration rates, and that African Americans are more likely to face discrimination from the police as well as being falsely arrested.
The New Jim Crow: Mass Incarceration in the Age of Colorblindness is a book by Michelle Alexander, a civil rights litigator and legal scholar. The book discusses race-related issues specific to African-American males and mass incarceration in the United States. Michelle Alexander (2010) argues that despite the old Jim Crow is death, does not necessarily means the end of racial caste (p.21). In her book “The New Jim Crow”, Alexander describes a set of practices and social discourses that serve to maintain African American people controlled by institutions. In this book her analyses is centered in examining the mass incarceration phenomenon in recent years. Colorblind racism utilizes non-racial mechanisms as explanatory frameworks for racial inequalities. Colorblind racism is derived of four central frames including: abstract liberalism, naturalization, cultural racism, and minimization of racism (Bonilla-Silva, 2017).
