The film, Central Park Five focuses on the catastrophic event where five Black and Latino American teenage boys (ages 14-16) were wrongfully convicted and sentenced. They were accused of brutally beating and raping a white woman. This was a huge turning point for the NYPD because the story of these young boys exposed repulsive interrogation tactics and the surprising way the city handled cases when under pressure by the media. The victim, Trisha Meili, a white lady was left for dead but she still clinged to life by a thread. During the interrogation of the teens a part of the fifth amendment was violated. I. Facts: 15-year-old delinquent, Gerald Gault and a friend were arrested after being accused of making a lewd phone call to a neighbor. Gerald’s parents were not notified of the situation. After a hearing, the juvenile court judge ordered Gerald to surrender to the State Industrial School until he reached the age of minority (21). Gerald's attorney petitioned for a writ of habeas corpus challenging the state of Arizona for violating the juvenile’s 14th Amendment due process rights. The Superior Court of Arizona and the Arizona State Supreme Court both dismissed the writ affirmatively deciding that the juvenile’s due process rights were not violated.

This movie really tied everything we’ve been discussing in class and seeing it unfold was actually really eye opening. I found it important going forward to make sure I do not fall into that tunnel vision mentality and to make sure I follow the evidence rather than fitting the suspect to the evidence. Again, I found it interesting like in the Norfolk Four case and in the Central Park 5 case police neglected to look at surrounding crime areas to see if any other cases matched the same modus operandi. If the police did look at surrounding cases they would have established a link between previous assaults and the assault that took place in the park that night. I was amazed how the detectives did not connect how each of the confessions varied by who did what and how they attacked the victim. It was Korey Wise in the video that kept putting up his hand when asked how big was the rock and he was just moving them back and forth. Police also neglected to look at the attack patterns of where the group first was hassling people in the park. They would have found that the boys were at one end of the park, while the victim was being attacked and there was no way they could have been in two places at once. I also found troubling during the time was the media portrayal of the Central Park 5, how they were painted as vicious young men, who brutally attacked a harmless white women. Even after each one of them was exonerated from the crime the media still portrayed them as vicious men. As we discussed in class, I think a lawyer like a magistrate should be available 24/7 when it comes to juveniles, because I believe that this five did not know their Miranda Rights and what they were entitled. Ken Burns the director of the movie is also known for his style of using archival footage and photographs in his documentary films. Other documentary films he is known for is The Civil War, Brooklyn Bridge, and Baseball. His other works don’t seem to be significant to the analysis of the film because they are mostly just about different types of topics that aren’t like this one but with the way that he does his types of films will help could help with the analysis because it gives an idea at the way that he convinces people. The Central Park Five are 5 young men who were convicted of a crime of raping a jogger in Central Park. They implicated themselves in the crime after hours of pressure and aggression during the integration. They were all released at different times but they spent six to thirteen years in prison. The movie the 13th centralizes that African-Americans are often criminals or dangerous in the eyes of the law. Since the end of slavery black people has always been at a disadvantage here in America. The novel All American Boys tells a story about how a good black kid, Rashad, gets beat up by a cop and a white kid, Quinn, who goes to the same school and is the same age and grade as Rashad and is seen as this “All American Boy,” seen it and goes through about if it was right or not. Both the novel and the movie has something to do between the two races, white and black. There’s always something that happens to a black person that leads to controversy and news.

At first, the Constitution was not ratify because it did not have a bill of rights which is a list of rights that belong to the people. Therefore to allow changes to the Constitution, the Framers created the amendment process. In 1791, congress proposed twelve changes to the Constitution. Ten of the twelve changes were agreed to by the states and were called “The Bill of Rights.” Some of these rights include the right of free speech, the right to practice your own religion and the right to be silent if you are arrested.

The clauses within the Fifth Amendment outline constitutional limits on police procedure. Within them there is protection against self-incrimination, it protects defendants from having to testify if they may incriminate themselves through the testimony. A witness may plead the fifth and not answer to any questioning if they believe it can hurt them (Cornell). The Bill of Rights, which consists of the first ten amendments to the U.S. Constitution, enumerates certain basic personal liberties. Laws passed by elected officials that infringe on these liberties are invalidated by the judiciary as unconstitutional. The Fifth Amendment was ratified in 1791; the Framers of the Fifth Amendment intended that its revisions would apply only to the actions of the federal government. After the Fourteenth was ratified, most of the Fifth Amendment's protections were made applicable to the states. Under the Incorporation Doctrine, most of the liberties set forth in the Bill of Rights were made applicable to state governments through the U.S. Supreme Court's interpretation of the Due Process and Equal Protection Clauses of the Fourteenth Amendment (Burton, 2007).
Over the years the way law enforcement officers have been able to investigate cases has been drastically changed over the years. Investigations used to be a very prying, and vindictive matter. Now it is very delicate. Since the Miranda case, law enforcement has been very open and aware of defendants’ rights.

The way the police officer Martin McFadden had ignored the fourth amendment in order to catch John W. Terry & Chilton that was planning to rob a store and so the officer had stop and frisk the two suspect in which McFadden had found a concealed weapon which was a .38 caliber pistol and had two of the gun on them and so that they were charged by that ignoring the fourth amendment to find that the two were going to rob the place but also McFadden had frisked a person. Terry sentenced to 3 years, Chilton had served 13 months.

The film displays the final twenty-fours of Oscar Grant’s lives going through his struggles, triumphs, and eager search to change his life around. There will be an analysis of the sociological aspects displayed throughout the movie that show racism, prejudice, and discrimination.
