Many people and nations around the world are deprived of human rights. The government in the countries or nations usually can not help the people being deprived. Either because the government is too poor to, it is not one of the things the government is looking into, or the government does not know or care. Because of this certain people, or even whole populations are denied human rights and their living conditions and way of life are usually not on the positive side of things. There are many wealthier countries trying to help but sometimes that is not enough. To what extent should Canada have a role in working to increase human rights protection in other nations?
Many countries around the world experience great poverty, maybe because the country has little amounts of natural resources or it has never gotten out of a slump that dragged down the economy. The people of the country are affected greatly by this, almost directly, if there are no resources available, people can’t work to refine the resources, make or use them. So instead of using the resources available, the country buys the materials needed. This puts the country in debt, along with the people. In order to get out of debt, taxes are raised and people slowly lose their jobs and their money. Being relatively young nations, both were conceived in a time when respect for civil liberties was growing and the idea of democracy was flourishing. While most of Europe developed democracy and current values and beliefs over centuries of monarchical rule, North America merely inherited the system from its European roots. Thus Canada and the US grew from a fundamental basis of independence and freedom, which developed into the conviction that both nations boast of today. Apart from the other laws in Canada’s constitution, the Canadian Charter of Rights and Freedoms is an important law that affects every Canadian’s rights and freedoms. It was created in 1981 by former Prime Minister Pierre Trudeau to provide legal protection for the most important rights and freedoms. These rights include fundamental freedoms, democratic rights, mobility rights, and legal rights. Most but not all articles included in the Universal Declaration of Human Rights are protected in the constitution. However, if a Canadian feels that their rights are violated, they can challenge laws and unfair actions using the justice system. In my opinion, I believe the Canadian Charter of Human Rights somewhat protects Canadians’ rights and freedoms to some extent depending on the situation.
The inclusion of the Notwithstanding Clause in the Canadian Charter of Rights and Freedoms was an invaluable contribution in the evolution of the liberal democratic state. Not an endpoint, to be sure, but a significant progression in the rights protection dynamic. Subsequent to its passage in 1982 it became the primary rights protecting mechanism, however, its raison d`etre was as a neccessary concession, the pivotal factor allowing the patriation of the constitution. Jonathan Lisus, a lawyer of The Canadian Civil Liberties Association, presented the argument that the current administrative segregation practice by the federal government is inherently unconstitutional. They don’t have the money to afford physical services and social events such as schooling, work, medicines, health care, sanitation, and transportation (ZPRP). The best way to condense the cause of non-income poverty is to make sure that individuals have access to inexpensive and exceptional social services, that they feel safe when in their homes and that they have family and friends to protect them when needed (ZPRP). Income poverty is when people are living on less than 1 dollar a day, which is far from the normal amount a family can survive on (ZPRP). They tend to not have fresh food and water, medicine, live in poor houses, sometimes no houses, and have dirty and ragged clothes (ZPRP).
