Predication: On 03/17/17, Asset Protection Manager(APM) Kristin Catucci contacted APM Jakub Orlando regarding a violation of the Be Safe policy by multiple team members at store 14181. Facts: On 03/20/17, APM Orlando reviewed CCTV Footage to confirm this allegation. CCTV Footage revealed that Shift Leader(SFL) Lauren Leonardi placed her hands on an individual and forcefully tried to push the individual out of the store. Additionally, Customer Service Associate(CSA) Stephanie Jean-Baptiste and CSA Terrence Smith physically tried to push suspected shoplifter out of the store. On 03/31/17, APM Orlando interviewed SFL Leonardi with Store Manager(SM) Vandana Lall as a witness. During the interview, SFL Leonardi stated that a person came to the store and attempted to steal beer but was unsuccessful as CSA Robert Francis grabbed the individuals bag in the aisle and asked the person to leave, which lead the to the individual leaving the store. During the interview, CSA Francis admitted to grabbing the suspected shoplifter bag in an aisle, knocking over merchandise in the aisle. On 04/05/17, All the facts of the case were presented to Human Resources Generalist(HRD) Michael Geyer and District Manager(DM) Nerendra Patel. They will try to create a narrative that Chris Archer intended to kill Milan Jackson in her task and that pushing her off of the ledge was the final straw. However, none of their witnesses were close enough to hear or see what was really going on. Archer states that they attempted to grab the shoulder of Milan to save her, while the prosecution's witnesses state that Milan was pushed from the shoulder. Fishel, 288 S.E.2d at 21; Dixon, 169 S.E.2d at 189. In Fishel, the customer was detained on the suspicion of shoplifting aspirin. 288 S.E.2d at 21. While he was detained the manager handcuffed him to the chair and made no attempt to investigate. Id. at 23. The manager's actions were not covered under the shopkeeper’s privilege because of the manager’s failure to reasonably investigate the customer's claims of innocence. Id. at 23. Conversely, in Dixon, the customer was detained on the suspicion of shoplifting for about forty-five minutes while the store’s employees investigated. 169 S.E.2d at 189. On April 26, 2016 at hours, Hampton County Sheriff’s Office responded to Shuman’s Store in the Cummings area of Hampton County in regards to a disturbance incident. Upon arrival, Hampton County Sheriff’s Office made contact with the store owner, Jack Mcalhaney, who stated an older male subject came inside the store earlier this incident date making verbal threats to harm a customer. On May 31, 2018 at approximately 1446 hours, I was dispatched to the Walmart located at 8701 US HWY 19 Port Richey, FL in reference to a W/M and W/F in the store concealing merchandise. Upon my arrival, I made contact with the complainant, Walmart Loss Prevention Associate Marion Edwards. Marion directed me to a W/M and W/F he advised were acting suspicious. He advised the subjects had loaded a shopping cart with hundreds of dollars worth of merchandise and were concealing merchandise in a plastic tote. Marion requested the subjects be issued trespass warnings from the store.
While conducting our business check, we were approached by Walmart management who led us to a female subject. The subject was removing price tag and concealing merchandise in several personal bags. The subject was being watched by Walmart Loss Prevention Officer, Marion Edwards, since 1:00 PM on this day. Several other Walmart employees also observed the subject concealing the merchandise.
