A patent provides patent owners with protection and exclusive rights to their invention for up to 20 years. However, if the patent owner gives consent, the patent protection can be extended or sold to commercial distributors or other interested parties based on agreed upon terms. Patent laws forbid people or businesses from exploiting a process or invention from being commercially used, distributed or sold by anyone other than the patent holder. The 802 committee and the OSI model both relate to one another. The OSI model shows how the layers of the internet are able to communicate and function with each other. While the 802 committee will add onto that by showing how network protocols should function. With that being said there are numerous working groups under the 802 committee however the one that I will be writing about is the 802.2 or the logical link control (LLC). The logical link control is in the 2nd layer (data-link) of the OSI model. The purpose of this protocol is flow and error control along with multiplexing and demultiplexing. Examples includes books, designs, music, art work, and computer files. (Miller R. J., 2011, p. 114) In the music industry a copyright is an important tool for artist to use to protect themselves from infringers. A copyright is the exclusive right of an author or originator of a literary or artistic production to publish, print, or sell that production for a statutory period of time. A copyright has the same monopolistic nature as a patent or trademark, but it differs in that it applies exclusively to works of art, literature, and other works of authorship (including computer programs). The Patents Act defines patent as a patent for any invention granted under the Act. An invention may relate to a new product or process. A patent confers on the patentee a bindle of rights for a limited period which includes the right to exclude others from manufacturing, using, offering for sale, selling or importing the invention in India. This limited monopoly can be exercised for a period of 20 years, after which any person can exploit the rights held by the patentee.

At the end of the day, the decision on if and how intellectual property (IP) protection is sought must be made in the context of an organizations IP strategy and keeping in line with the organization goals and objectives. For company who prefer to compete in the free market, copyrighted software is sufficient in protecting the legal rights of the software created. For company whose main objective is to collect licensing rights and back end deals that comes with patent protection, than it is advisable to seek for patent protection. For me, a copyright is more than sufficient to acknowledge an invention and the inventor’s rights to claim.
