The dictionary defines discrimination as the unjust or prejudicial treatment of different categories of people or things, especially on the grounds of race, age, or identified sex and sexual orientation. The term LGBT stands for, lesbian, gay, bisexual and transgender. These terms refer to sexual orientation and also gender identity. Every day people of the LGBT community suffer wrongful terminations and oppression in their schools for their sexual orientation or identified gender.
For example, one issue that has yet to be dealt with is the matter of discrimination in the workplace environment. Currently, it is legal in 34 states for an employer to terminate an employee on the basis of their sexual orientation. Only 21 states and Washington D.C. have laws that disallow discrimination against sexual orientation, and 17 states and the District of Columbia have some type of laws in place concerning discrimination against gender identity. The Employment Non-Discrimination Act, or ENDA, “would provide basic protections against workplace discrimination on the basis of sexual orientation or gender identity” (Human Rights Campaign). The act follows basic given civil rights laws granted to every American. The bill has passed the Senate, and now journeys to the House of Representatives for consideration, but currently there is only a 14 percent chance of the bill even being ratified. The percent chance is extremely discouraging, not only to people who have experienced discrimination but to civil rights advocates across the country.

The central facts in this case are; Cracker Barrel felt justified in firing and not hiring homosexual in their restaurants, the company informed them that this is the reason they were not receiving employment, and the company has had accusations of discriminating against blacks. Some sub issues are the fact the homosexuals can not press charges or receive monetary compensation for their loss.
Lesbian, gay, bisexual, and transgender (LGBT) individuals people make up more than ten percent of the population; that means if you are sitting in a classroom of thirty, then more than three of those people are LGBT individuals. However, this overwhelmingly large minority group continues to be one of the least protected by the government as well as most heavily targeted by discrimination and hate crimes. Regardless of the powerful shift in public opinion concerning LGBT individuals during the last twenty years, the laws concerning hate crimes have remained invariable.
Holbrook’s purpose in writing this article is to point out the dangers of these types of legislation. He points out how simple it was to pass a law that legalizes the infringement of civil liberties based solely on differing lifestyles. This sets a dangerous precedent as well as harken back to the days of Jim Crow laws and segregation. He wonders how discrimination can come so easily to our elected government officials and what does that say about us as a society. He also wants to show us the consequences that could come about from these types of bills. Indiana recently passed similar laws and the impact has been overwhelmingly negative on the state. He simply wants everyone involved to take a step back and think about these points

Tangibly speaking, discrimination occurring on the basis of sexual orientation, while small in aggregate numbers, reaches the same rates as gendered discrimination against women in the workplace, when measured at a per capita rate, and creates a situation in which homosexual and transgendered individuals typically earn 10 or more percent less income than their heterosexual peers (Croteau, 1996). With this, sexual orientation-based discrimination is a significant problem in American society. In a broad sense, the pervasiveness of this discrimination is facilitated by the significant permeation of religious bias into America's ostensibly secular democracy and civil society. Tangibly, large religious organizations such as the Catholic and Mormon Churches have waged proverbial wars against LGBT individuals, seeking to deny them of equal rights in many American states, with a notable example being the battle over Proposition 8 in the state of California (Wilcox & Iida, 2011, 181-183). Furthermore, anti-gay hate speech emerging from groups such as Fred Phelps' Westboro Baptist Church has permeated the country's public sphere, and thus contributed to a climate that is hostile to LGBT individuals, and which has unfortunately seeped into the business environment, in both systematic and idiosyncratic ways (Barrett-Fox, 2010, 4-5).

When one hears the words “LGBT” and “Homosexuality” it often conjures up a mental picture of people fighting for their rights, which were unjustly taken away or even the social emergence of gay culture in the world in the1980s and the discovery of AIDS. However, many people do not know that the history of LGBT people stretches as far back in humanity’s history, and continues in this day and age. Nevertheless, the LGBT community today faces much discrimination and adversity. Many think the problem lies within society itself, and often enough that may be the case. Society holds preconceptions and prejudice of the LGBT community, though not always due to actual hatred of the LGBT community, but rather through lack of knowledge and poor media portrayal.
